Alert 340 Thailand Accedes to PCT
On 24 September, 2009 Thailand's Deputy Minister of Commerce, Mr Alondkorn Ponlaboot, deposited his country's instrument of accession to the Patent Cooperation Treaty (PCT) with Francis Gurry, Director General of the World Intellectual Property Organisation. This follows signature of the Act of Accession of Thailand to the PCT by the National Legislative Assembly of Thailand on 10 January, 2008.
Thailand is the 142nd contracting state of the PCT, which facilitates the filing of patents in multiple countries. The treaty will enter into force for Thailand on 24 December, 2009. It covers both patents for invention and utility models.
The accession by Thailand means that in any international application filed on or after 24 December, 2009, Thailand (country code: TH) will be automatically designated. Thailand will also be automatically elected in any demand for international preliminary examination filed in respect of an international application filed on or after 24 December, 2009. In addition, as of that date, nationals and residents of Thailand will themselves be able to file PCT applications.
